Online personal training course provider, FitLearn Ltd (“the Company”), has ceased trading and will be entering Creditors Voluntary Liquidation.

Since contacting Leading, the director’s primary concern was the welfare of the Company’s students. The Company’s awarding body advised that they would only offer certifications for students who submitted all completed course work and paid all certification costs up to 1 July 2019. Therefore, initially a contractor was sourced to allow students to complete their qualifications relating to Level 2 Certificate in Fitness Instructing (Gym-Based) and Level 3 Certificate in Personal Training.

During this time, the Company was approached by an unconnected third party who made an offer to purchase the customer list and contracts to allow students to continue their studies and complete their courses. Despite extensive negotiations, the sale fell through and no other offers were forthcoming.

On 11 June 2019, the Company became aware that one of the learning portals where students were able to access learning materials was taken offline. As a result, the relationship between the Company and the contractor has been terminated and no further assessments will be completed.

Notification of the liquidation will be sent to creditors in due course.

How does liquidation work? 

As above, the Company has instructed Leading to place the Company into voluntary liquidation. The Company has ceased trading.

As part of this process, a liquidator is appointed and it is the liquidator’s responsibility to realise the Company’s assets for the benefit of creditors. If there are sufficient assets available, the funds recovered by the liquidator may be distributed to creditors equally, and in the statutory order of priority.

How do I know if I’m a creditor? 

If have enrolled and paid for any FitLearn course which has not been completed and you have not received your certification, you will be classed as an unsecured creditor.

If my course is cancelled, will I get my money back? 

Based on the information provided to date, it appears unlikely that there will be assets available to issue a dividend to creditors. What this means is that if you are owed money by the Company (i.e course enrolment fees) you will not obtain a refund for these monies from the company.

We understand that this is a disappointing and frustrating position for creditors, and should the position change creditors will be notified of this.

As above, you will not be able to obtain a refund from the Company or Leading.

Can I claim from my bank or credit card company?

It may be possible for you to seek a refund of your fees from your bank or creditor card company. Please contact your bank directly to discuss this with them. If your bank needs anything from the liquidators, please email us at fitlearn@leading.uk.com

How can I keep updated regarding the liquidation?

If you are owed money by the company, you can be added to the list of creditors by completing a proof of debt form. This can be downloaded here: Proof of Debt Form.

Please ensure this proof of debt form is completed and emailed to fitlearn@leading.uk.com

If you do not complete and return a proof of debt form, you will not be added to the list of creditors and will not receive any progress reports regarding the liquidation.

We should remind you that it is not anticipated that there will be any funds to pay out to people owed money by the company.

How long will the liquidation last?

There is no fixed timescale for how long the liquidation may last, however cases are usually completed within 6 to 12 months if there are no substantial issues to deal with.
